Domain Registrations Trusts

Why do I need to perform a correction to my Domain registered under a Trust?

auDA changed its policy in 2021 to no longer allow the trust entity to register Domain Names, requiring that they be registered to the trust's Trustee rather than directly to the Trust. Failure to update your Trust to be registered to the Trustee may result in the suspension or deletion of your Domain if not resolved before renewing your Domain.

How can I resolve this?

My Domain has less than 90 days until expiry:

Around domain expiry, a representative of ResolvIT or an email will automatically be sent to the Registrant, asking them to provide the correct Trustee information. You will need to provide the correct Trust details to use so we can make the necessary changes. Once those details are provided, our system will attempt to approve the Registrant correction automatically; any attempts not automatically approved will be sent to our team for review. If additional information is required, our team will contact you to request it.

My Domain has more than 90 days until expiry:

If the domain has an 'invalid AU eligibility' flag and is eligible for a correction, ResolvIT will attempt to initiate one with the auDA registrar. This will email the Registrant asking for the correct Trustee information. Once manually initiated, our team will contact you should we require further details. Once those details are provided, our system will attempt to approve the Registrant correction automatically; any attempts not automatically approved will be sent to our team for review. If additional information is required, our team will contact you to request it.

How to identify the Trustee of the Trust:

You’ll need to list the Trustee’s details as the Registrant, not the name of the Trust itself.

  • For a company trustee, use the full company name and its ABN or ACN.
  • For an individual trustee, use their full legal name.

You can find the Trustee listed in the trust deed. This will typically appear in one of two places:

  • Near the start of the document in the Recitals section, in a sentence like: “John Citizen of 1 Sample Street, Hobart (‘the Trustee’)”
  • At the end of the document on the Schedule page, next to a label such as: “Trustee: [Name]”

Ensure you use the Trustee’s name, not just the Trust name, as shown in the deed.

Is there a Fee Associated with this Change?

The registry charges a fee associated with this change, and ResolvIT also charge a fee for the work involved. The fees are approximately the cost of a domain renewal and also include and additional years' registration included.
